Terms of Use for ROOMCO
Preamble
"ROOMCO" "us" or "our" is an online chat application providing "Users" or "you" with messaging services by creating and participating in "room" chat rooms, as well as other services around the world.
These terms and conditions (hereinafter "Terms") are intended to set the conditions of use of the Services we offer.
By downloading and installing our applications, services, features, software or websites (collectively, the "Services"), you are presumed to know and accept, without reservation, all of our Terms, regardless of the devices used.
1. Information about our Services
1.1 The minimum age required
You must be at least 13 years old to use our Services. If you are not yet the minimum age requirement in your country under applicable law, you may use our Services only if a legal representative or guardian accepts these Terms on your behalf.
By using any of our Services, you agree to our Terms in your country, and confirm your legal capacity to enter into these Terms.
1.2 Your account in the application
By creating an account on the app, you are required to provide accurate information.
The identifiers provided during registration will allow you to log on the application.
You are fully responsible for protecting your device, account and the password you have chosen. This password is the guarantee of the confidentiality of the information contained in your account. If you think someone has access to your account, contact us at: contact@roomco.com
If you contravene these Conditions, ROOMCO reserves the exclusive right to delete your account, and you will not be entitled to any compensation as a result of this exclusion.
If we delete your account, only written authorization from us will allow you to create others.
1.3 Software and updates
In order to use our Services, you must have certain software and devices.
Throughout the life of our Services, you agree that any software or updates to our Services may be downloaded or installed, including automatically.
These updates help improve and optimize our services.
1.4 "VIP Roomer" subscription and paid services:
1.4.1 "VIP Roomer" subscription
Although the standard service on ROOMCO is free, you can subscribe to a paid "ROOMER VIP" subscription, and thus benefit from the following functionalities:
- Create and moderate a VIP room with possibility to exclude roomers;
- Choose to make his VIP room public or private with password access;
- Create an ephemeral VIP room by choosing its lifespan;
- Choose the number of roomers present in his room;
- Put color in your discussions;
- Receive a notification when a room is full and a place is free;
- Ability to add an unlimited number of rooms and roomers in favorites;
- Block an unlimited number of roomers.
Once the payment has been validated, an overview of the payment order, including the purchase reference, the duration of the selected Subscription, the amount invoiced and the billing date will be displayed. We will acknowledge receipt of the purchase by email as soon as it is validated, which will include the main characteristics of the service subscribed, namely the duration of the subscription, the billing cycle and the amount invoiced.
2. Services offered by third party
Our Services may allow you to view or use third-party services.
When you use the services of third parties, their general terms and conditions will govern their relationship with you. ROOMCO can not be held responsible for the conditions and Services offered by third parties.
3. Security and rules of conduct
You must use our Services only for acceptable and lawful purposes.
It is strictly prohibited to download, publish, send or store the content that:
(a) violates the rights of users of our Services or of third parties, including all rights of intellectual property and personality rights;
(b) to usurp the identity of a third party;
(c) is misleading, illegal or promotes illegal activity;
(d) is obscene, defamatory, threatening, violent, assimilated to harassment, and that promotes or incites to violence, racism, discrimination, hatred, and more generally any illegal behavior on the part of the users of our Services;
(e) solicits ROOMCO users for advertising, commercial purposes or not (including spam).
(f) is unintelligible, off topic or posted in several discussions at the same time, it is forbidden to use our Services to:
(a) collect the personal data of our users, without their consent, automatically or not;
(b) download or distribute computer viruses or any software intended to damage or alter data or a computer system;
4. Intellectual property rights.
All copyrights, trademark rights, logos, content and other intellectual property rights belong to ROOMCO or a third party agent, or are used by ROOM CO with the authorization of their owner. Any copy of the logos, textual contents, without this enumeration being exhaustive, without authorization on our part is strictly prohibited and is like counterfeiting.
4.1 Rights that ROOMCO grants you
ROOMCO grants you an international, free, non-exclusive, non-transferable, revocable, non-sublicensable license to access and use our Services in a non-commercial manner, in accordance with and subject to these Terms.
The license only allows you to use and enjoy our Services as permitted by our Terms and our Privacy Policy.
You must not assign, copy, adapt, modify, distribute, sublicense, create derivative works of our Services.
In addition, you may not modify, disassemble, decompile, attempt to discover the source code or reverse engineer any part of our Services.
4.2 Rights you grant us
In order for us to exploit and offer our Services, you grant us an international, non-exclusive, royalty-free, sublicensable, license to use, reproduce, distribute, display and exploit the information. (including content) that you upload, submit, store, send or receive on or through our Services, and to create derivative works thereof. The rights you grant under this license are for the limited purposes of operating and providing Services (for example, to allow us to view your profile picture and status message, transmit your messages, store your undeliverable messages on our servers for up to 30 days as long as we attempt to send them, and in accordance with any other description in our Privacy Policy).
You are responsible for the content you broadcast through the Services, which we may review, filter, and delete at any time if we believe that it may violate these Terms.
In exchange for access to and use of our Services, you agree that ROOMCO, its affiliates and third party partners may place advertising on our Services.
5. Privacy and personal data
By using our Services, you agree that ROOMCO may collect, use, share your information as described in our Privacy Policy.

6. Exemption from liability in the execution of these Conditions
In case of impossibility of access to our Services, due to technical problems or all kinds, you can not claim any damage or claim any compensation. We do not warrant that our Services are error free and harmless.
We can not be held responsible for any viruses that could infect your electronic devices, following use, access, or download from this site.
In addition, the hypertext links on the application may refer to other applications or websites, and our responsibility can not be engaged if the content of these sites and applications violates the laws in force.
7. Limitation of Liability.
Our responsibility and that of partners, suppliers and affiliated companies, can not be engaged for any damage, direct or indirect, resulting from the use of our Services, such as the loss of data, the intrusion, the viruses, the lack to win, malfunctions, or other, within the limits of applicable laws.
We can not be held responsible for any damage resulting from the occurrence of force majeure or the unpredictable and insurmountable event of a third party, within the limits of the applicable laws.
Moreover, we can not be held responsible for the content of online conversations. However, you have the option to report a breach of the rules of these Terms, including notifying any inappropriate content.
8. Law and legal Jurisdiction
These Conditions are subject to the application of French laws, subject to conflict of law rules.
Unless otherwise provided, of a public order, any judicial action relating to the execution of these Conditions shall be subject to the jurisdiction of the French courts of the Court of seized Appeal.
This attribution of jurisdiction does not however prevent the application of the police laws in force in certain countries.
9. Modification of our Services and termination
The creation of new services and the improvement of our Services may lead us to modify, supplement or delete unilaterally elements of our Terms.
Users will be informed of the nature of the changes during their first connection according to these. Users will then be obliged to take note of the modifications considered and to accept them.
The application of the new Terms and Conditions is immediate as soon as they are posted online.
We may also terminate your use or consultation of our Services or disable your account, if we believe that you have violated these Terms or for any reason whatsoever.
We also reserve the right to disable your account if you are inactive for at least 1 year.
We can not be held responsible for the modification or deletion of our Terms, including the termination of your ROOMCO account or the deletion of your content.
